RE: Formal Appeal — Penalty Charge Notice Ref. LCC/PCN/2025/087432

Dear Sir or Madam,

I write to formally appeal against the Penalty Charge Notice issued on 28 February 2025, reference LCC/PCN/2025/087432, in respect of vehicle registration KT18 LMN, for the sum of £70.00. I am the registered keeper of the vehicle and submit that this charge is unlawful and should be cancelled in full.

Pursuant to Schedule 4 of the Protection of Freedoms Act 2012, a parking operator may only pursue the registered keeper for an unpaid charge where the signage at the location is clear, conspicuous, and legible. I attended the site on 1 March 2025 and photographed the signage in question. The primary restriction notice was partially obscured by overgrown vegetation and positioned at an angle that rendered it effectively invisible to a motorist approaching from that direction. This failure renders the charge unenforceable under the Act.

I further note that the Notice to Keeper was not issued within the period prescribed by Schedule 4, paragraph 9(2) of the Act. The notice must be given within 14 days of the parking event. The notice I received is dated 17 March 2025 — 17 days after the alleged contravention — and is therefore out of time and invalid on this ground alone.

I require written confirmation that this Penalty Charge Notice has been cancelled by 28 March 2025. Should I not receive such confirmation within 14 days, I will refer this matter to POPLA without further notice and reserve the right to seek recovery of all associated costs.
